These Terms of Service ("Terms") govern your access to and use of the HabitPet mobile application ("HabitPet" or the "App"), operated by Grownictech ("we", "us", or "our"). By downloading, installing, or using the App you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. The service
HabitPet is a personal habit tracker featuring an AI-powered virtual pet that grows based on your consistency. The App offers a free tier and a Pro subscription with additional features.
2. Eligibility and account
- You must be at least 13 years old (or the minimum legal age in your jurisdiction) to create an account.
- You are responsible for keeping your login credentials secure and for any activity that occurs under your account.
- You agree to provide accurate information when registering and to keep it up to date.
3. Subscriptions and billing
Pro plans
HabitPet Pro is offered as a monthly or annual auto-renewing subscription. The price is shown inside the App at the time of purchase. New subscribers may receive a 7-day free trial; the availability of the trial is determined by Apple based on your account.
Payment
Purchases are processed through your Apple ID. Payment is charged at confirmation. Your subscription renews automatically at the end of each billing period unless you cancel at least 24 hours before the end of the current period.
Cancellation and refunds
- You can cancel anytime from your iOS Settings → [your name] → Subscriptions. Your access remains active until the end of the paid period.
- Refund requests are handled by Apple. We do not have the ability to refund purchases directly. See Apple's refund policy.
Price changes
We may change subscription prices in the future. We will notify you in advance and, where required by Apple, your consent will be requested before any price increase takes effect.
4. Your content
You retain all rights to the habits, names, and content you create inside the App. You grant us a limited license to store, process, and display your content as needed to operate the App and deliver the service to you.
5. AI-generated content
Messages from your virtual pet are generated using Google's Gemini model. AI output may occasionally be inaccurate, incomplete, or unexpected. HabitPet is not a medical, mental health, or fitness professional service — do not rely on AI messages as professional advice.
6. Acceptable use
You agree not to:
- Reverse-engineer, decompile, or attempt to access the source code of the App outside of what is allowed by law.
- Use the App to violate any law or infringe the rights of others.
- Attempt to access or interfere with accounts that do not belong to you.
- Use automated scripts, bots, or scrapers to access the service.
- Submit content that is illegal, harmful, harassing, or that infringes intellectual property rights.
We may suspend or terminate accounts that violate these rules.
7. Intellectual property
The HabitPet name, logo, mascot designs, illustrations, code, animations, copy, and overall experience are owned by Grownictech and are protected by intellectual property laws. These Terms do not grant you any right to use our trademarks or copyrighted materials beyond normal use of the App.
8. Health and disclaimer
HabitPet is a productivity and motivation tool. It does not provide medical, psychological, fitness, nutritional, or financial advice. If you have specific health goals or conditions, consult a qualified professional. By using HealthKit integration, you acknowledge that HabitPet is not a medical device.
9. Termination
You can stop using the App at any time and delete your account from the in-app Profile screen. We may also suspend or terminate access if you violate these Terms or if we discontinue the service. Upon termination, the obligations that by their nature should survive (intellectual property, disclaimers, limitation of liability) will remain in effect.
10. Disclaimer of warranties
The App is provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, secure, or that defects will be corrected.
11. Limitation of liability
To the maximum extent permitted by law, Grownictech is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill resulting from your use of the App. Our total liability for any claim arising from these Terms or the App is limited to the amount you paid us in the 12 months preceding the claim.
12. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will notify you inside the App or by email. Continued use of the App after the changes take effect constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of Honduras, without regard to conflict-of-law principles. Any dispute will be brought before the competent courts of Honduras, unless mandatory consumer protection laws in your country provide otherwise.
